The way I see it; Raila Odinga has to protest counting the votes that resulted in him getting 43% of the vote, and Uhuru Kenyatta 50.3%. He reported that more votes were counted than people registered to vote; and that some ballots were discovered discarded: that all sounds like grounds for appeal to me.
His complaint to Kenyan courts will not make any difference to the governing of Kenya right now: the baton has been passed.
I do not believe filing a complaint of refusing to concede the elections diminishes him, or takes away from President Kenyatta.
Prime Minister Odinga has had a distinguished career, is the son of a father of Kenya, and has been prime minister under President Kibaki for 5 peaceful, prosperous years, after 2 months of murder and mayhem after the Dec 2007 elections.However, even as the celebrations and protests of election results are non-violent, and optimism is the abiding sentiment, Kenya is still in hot water.
A real problem facing Kenya is that its president and vice president have been indicted in the International Criminal Court. This is not a minor matter, and for them to avoid being jailed, they are going to have to come up with a really great defense.
The International Criminal Court was set up with the Rome Statute in 2002. I was invited to celebrate the 10th anniversary of its existence at the Free Public Library in Philadelphia in Sep 2012.
I learned a lot about the court: it was created to prosecute criminals whose own countries could not or would not prosecute.
The court indicted the president of Libya, Moamar Gaddafi for crimes against humanity: the proceedings ended when Gaddafi was shot dead in Libya.
The Kenyan indictments are way more complicated. The crimes against humanity charges have been made against President Uhuru; but also his vice president, William Ruto, with whom he has been widely photographed smiling and holding hands high. This does not lessen the fact that over 1,000 Kenyan citizens were brutally murdered during post-election violence from Dec 2007 to Feb 2008, but does suggest that these 2 are not hell-bent on annihilating each other and their supporters.
The International Criminal Court moves slowly; slower than acts of love and forgiveness that reach across unspeakable horror. Uhuru and Ruto have forgiven each other, and have promised Kenyans they can look forward to continuing prosperity and peace.

Today,
8 March 2013, Trial Chamber V of the International Criminal Court (ICC)
decided to grant the Defence teams’ requests, to which the Prosecutor
did not oppose, and to postpone the opening of the trial in the case The
Prosecutor v. William Samoei Ruto and Joshua Arap Sang. The Chamber
vacated the trial commencement date of 10 April and set the new date for
28 May 2013.

did not oppose, and to postpone the opening of the trial in the case The Prosecutor v. Francis Kirimi Muthaura and Uhuru Muigai Kenyatta and set the new date provisionally for 9 July 2013.

Uhuru Kenyatta was indicted on 8 March 2011 on 5 counts of crimes
against humanity in the Republic of Kenya.
Kenyatta is alleged to have planned, financed, and coordinated the violence perpetrated against the perceived supporters of the Orange Democratic Movementt, the political party of President Kibaki's rival, from 27 December 2007 to 29 February 2008.
Kenyatta is alleged to have "had control over the Mingiki organization" and directed it to conduct murders, deportations, rapes
and other forms of sexual violence, persecutions, and other inhumane
acts against civilians in the towns of Kibera, Kisumu, Naivasha and Nakuru.
William Ruto was indicted on 8 March 2011 on 4 counts of crimes
against humanity in the Republic of Kenya.
He is alleged to be the leader of an ad hoc organization created
by ethnic Kalenjins to perpetrate violence on behalf of the Orange
Democratic Movement (ODM) in Dec 2007 and Jan 2008.
On 1 Aug 2011, the charges were reduced to 3 counts.
Ruto is alleged to be criminally responsible for the murder,
deportation, torture, and persecution of civilians in the towns of Kapsabet, Nandi Hills, Turbo, the greater Eldoret area.
